Terms of Service

1. Acceptance of Terms
By accessing our website or engaging Pixelbytes for services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Pixelbytes provides digital services including but not limited to web development, mobile app development, UI/UX design, brand identity, e-commerce solutions, and digital strategy. The specific scope of services for each project is defined in a separate project agreement or proposal.
3. Project Agreements
All projects require a signed proposal or statement of work outlining:
• Project scope, deliverables, and timelines
• Payment terms and milestones
• Revision rounds included
• Ownership and intellectual property rights
• Confidentiality obligations
These Terms of Service apply in addition to any project-specific agreements.
4. Payment Terms
Unless otherwise stated in the project agreement:
• A deposit of 50% is required before project commencement
• Final payment must be completed before the delivery of any final files, source code, credentials, or deployment of the project.
• Payments are non-refundable once work has commenced
• Late payments may incur a 2% monthly interest charge
• We reserve the right to pause work on accounts with outstanding invoices
5. Recurring Fees & Renewals
Certain services provided by Pixelbytes, including but not limited to domain registration, hosting, maintenance, and ongoing support, are billed on a recurring (typically annual) basis.
By engaging these services, the client agrees that:
• All recurring services must be renewed before their expiration date to avoid service interruption
• Pixelbytes is not responsible for any loss of data, downtime, or service disruption due to non-renewal or delayed payment
• Renewal reminders may be provided, but it is ultimately the client’s responsibility to ensure timely payment
• Pricing for renewals may be subject to change based on third-party provider costs or service upgrades, with prior notice to the client
• Failure to renew services on time may result in additional reactivation or setup charges
NOTE: Pixelbytes reserves the right to suspend or terminate associated services if renewal payments are not received by the due date.
6. Intellectual Property
Upon receipt of full payment:
• You will own the final deliverables created specifically for your project
• Pixelbytes retains ownership of all preliminary concepts, unused designs, and proprietary tools/frameworks used in delivery
• We reserve the right to showcase completed work in our portfolio unless agreed otherwise in writing
• Third-party assets (fonts, stock images, plugins) are subject to their respective licenses
7. Client Responsibilities
To ensure smooth project delivery, clients agree to:
• Provide timely feedback within agreed review periods
• Supply all required content, assets, and credentials promptly
• Ensure all provided materials do not infringe third-party rights
• Designate a single point of contact for project communication
• Notify us promptly of any changes in project requirements
8. Revisions & Change Requests
Each project includes a defined number of revision rounds as specified in the project agreement. Additional revisions or scope changes beyond the agreed terms will be quoted and billed separately. A change request must be submitted in writing and approved before implementation.
9. Timelines & Delays
We commit to delivering projects within agreed timelines. However, any delay in client feedback, content submission, approvals, or required resources will automatically result in a corresponding extension of the project timeline. Pixelbytes shall not be held responsible for delays caused by such client-side factors.
10. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the termination of the project agreement.
11. Limitation of Liability
Pixelbytes's total liability for any claim arising from our services shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data loss.
12. Warranty & Support
We provide a 30-day bug-fix warranty on all delivered work from the date of final delivery. This covers bugs within the originally agreed scope. It does not cover new feature requests, third-party service failures, or issues arising from client modifications.
13. Termination
Either party may terminate a project agreement with 14 days written notice. Upon termination:
• You will be invoiced for all work completed to date
• All completed deliverables will be handed over upon receipt of outstanding payment
• Each party will return or destroy the other's confidential materials
14. Governing Law
These Terms of Service are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand, India.
15. Changes to Terms
We reserve the right to update these Terms of Service at any time. Updated terms will be posted on this page. Continued use of our services after changes constitutes acceptance of the revised terms.
16. No Guarantee of Results
Pixelbytes does not guarantee specific business outcomes, including but not limited to increased sales, website traffic, user engagement, or conversions, unless explicitly agreed in writing. All services are provided based on industry best practices and expertise, but results may vary depending on external factors beyond our control.
17. Project Abandonment
If the client becomes unresponsive for a period of 14 consecutive days or more, the project will be considered abandoned. Pixelbytes reserves the right to close the project, and any further work to restart the project may be subject to additional fees and revised timelines.
18. Access & Credentials
Clients are responsible for securely sharing all necessary access credentials required for the project. Pixelbytes shall not be held liable for any security breaches, data loss, or unauthorized access resulting from improper handling or sharing of credentials by the client.
19. Third-Party Services
Pixelbytes is not responsible for any issues, downtime, errors, or losses caused by third-party services, including but not limited to hosting providers, domain registrars, payment gateways, plugins, APIs, or external software integrations.
