Terms of Service

1. Acceptance of Terms

By accessing our website or engaging Pixelbytes for services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Pixelbytes provides digital services including but not limited to web development, mobile app development, UI/UX design, brand identity, e-commerce solutions, and digital strategy. The specific scope of services for each project is defined in a separate project agreement or proposal.

3. Project Agreements

All projects require a signed proposal or statement of work outlining:

• Project scope, deliverables, and timelines
• Payment terms and milestones
• Revision rounds included
• Ownership and intellectual property rights
• Confidentiality obligations

These Terms of Service apply in addition to any project-specific agreements.

4. Payment Terms

Unless otherwise stated in the project agreement:

• A deposit of 50% is required before project commencement
• The remaining balance is due upon project completion before final delivery
• Payments are non-refundable once work has commenced
• Late payments may incur a 2% monthly interest charge
• We reserve the right to pause work on accounts with outstanding invoices

5. Intellectual Property

Upon receipt of full payment:

• You will own the final deliverables created specifically for your project
• Pixelbytes retains ownership of all preliminary concepts, unused designs, and proprietary tools/frameworks used in delivery
• We reserve the right to showcase completed work in our portfolio unless agreed otherwise in writing
• Third-party assets (fonts, stock images, plugins) are subject to their respective licenses

6. Client Responsibilities

To ensure smooth project delivery, clients agree to:

• Provide timely feedback within agreed review periods
• Supply all required content, assets, and credentials promptly
• Ensure all provided materials do not infringe third-party rights
• Designate a single point of contact for project communication
• Notify us promptly of any changes in project requirements

7. Revisions & Change Requests

Each project includes a defined number of revision rounds as specified in the project agreement. Additional revisions or scope changes beyond the agreed terms will be quoted and billed separately. A change request must be submitted in writing and approved before implementation.

8. Timelines & Delays

We commit to delivering projects within agreed timelines. However, delays caused by late client feedback, missing content, or scope changes may affect delivery dates. Pixelbytes is not liable for delays outside our reasonable control.

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives the termination of the project agreement.

10. Limitation of Liability

Pixelbytes's total liability for any claim arising from our services shall not exceed the total fees paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data loss.

11. Warranty & Support

We provide a 30-day bug-fix warranty on all delivered work from the date of final delivery. This covers bugs within the originally agreed scope. It does not cover new feature requests, third-party service failures, or issues arising from client modifications.

12. Termination

Either party may terminate a project agreement with 14 days written notice. Upon termination:

• You will be invoiced for all work completed to date
• All completed deliverables will be handed over upon receipt of outstanding payment
• Each party will return or destroy the other's confidential materials

13. Governing Law

These Terms of Service are governed by the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand, India.

14. Changes to Terms

We reserve the right to update these Terms of Service at any time. Updated terms will be posted on this page. Continued use of our services after changes constitutes acceptance of the revised terms.
